Copyright Issues

OVERVIEW CONSULTANTS, has a copyright in www.HRMining.com, a work not to be infringed without our express permission , except in certain conditions, eg, for research, study, criticism, review and news reporting, as well as use of works in library and schools and in the legislatures, is permitted without specific permission of the copyright owners.

The Copyright Act, 1957 protects our  works .Copyright protects the rights of authors, i.e., our intellectual property.  In the case of a computer generated work, OVERVIEW CONSULTANTS has caused the work to be created.

OVERVIEW CONSULTANTS may assign to any person the copyright either wholly or partially and either generally or subject to limitations and either for the whole term of the copyright or any part thereof.

It shall be in writing signed by the OVERVIEW CONSULTANTS or by its duly authorised agent. It shall identify the specific works and specify the rights assigned and the duration and territorial extent of such assignment. It shall also specify the amount of royalty payable, if any, to the author or his legal heirs during the currency of the assignment and the assignment shall be subject to revision, extension or termination on terms mutually agreed upon by the parties.

OVERVIEW CONSULTANTS  enjoys the rights to sell or give on hire or offer for sale or hire, regardless of whether such a copy has been sold or given on hire on earlier occasion.

No person shall make one or more copies  in any material without the permission of the copyright owner.

OVERVIEW CONSULTANTS can take legal action against any person who infringes the copyright in the work. OVERVIEW CONSULTANTS is entitled to remedies by way of injunctions, damages and accounts.

The District Court in New Delhi has the jurisdiction in civil suits regarding copyright infringement.

Any person who knowingly infringes or abets the infringement of the copyright in any work commits criminal offence under Section 63 of the Copyright Act

Every person who at the time the offence was committed was in charge of, and was responsible to the company for, the conduct of the business of the company, as well as the company shall be deemed to be guilty of such offence and shall be liable to be proceeded against.
